Please read the following Terms and Conditions of Use carefully. If you do not accept these Terms and Conditions of Use you must not access or use this Website. Use of this Website constitutes your acceptance of these Terms and Conditions of Use.
1 Definitions
1.1 In these Terms and Conditions of Use the following words and phrases shall have the following meanings unless the context otherwise requires:-
“Bristol Job Market” / “Our” / “Us” / “We” means Bristol Job Market Limited, a company registered in England and Wales under Company Number 06258713 and with a registered address at 474b Bath Road, Saltford, Bristol BS31 3DJ
“CV” means the curriculum vitae or brief outline details of a candidate’s education, training, skills and employment experience which is provided to Us by a candidate for distribution to clients with a view to securing employment
“Privacy Policy” means Our Privacy Policy which can be accessed here
“Site” means this bristoljobmarket.com
“Terms” means these Terms and Conditions of Use provided by Us
“The Regulations” means the Conduct of Employment Agencies and Employment Businesses Regulations 2003
“You” / “Your” / “Yourself” means an authorised user of this Site
1.2 In these Terms:-
(a) references to the masculine include the feminine and neuter and the singular include the plural and vice versa as the context admits or requires;
(b) words importing persons include individuals, bodies corporate and unincorporated;
(c) references to any statute or statutory provision shall, unless the context otherwise requires be construed as a reference to that statute or statutory provision as from time to time amended, consolidated, modified, extended, re-enacted or replaced;
(d) the headings used within these Terms are for convenience only and shall not affect their interpretation.
2 General
2.1 In accordance with the following Terms, We grant to You as an authorised user of this Site certain rights (as set out below) and in return You agree to perform certain obligations.
2.2 These Terms should be read in conjunction with our Privacy Policy.
2.3 If you do not agree with these Terms and do not wish to be bound by them, please exit this Site and do not use the Site in the future.
2.4 Our use of CVs and other personal information supplied by users of this Site are governed by our Privacy Policy.
2.5 We do not make any representation whatsoever about any job vacancy advertisement which is accessed either on, by virtue of or by way of any links from this Site nor about any of the advertisers who appear on this Site because in compiling the same We rely on information provided to Us by third parties. Accordingly it is a matter for You to satisfy Yourself as to the suitability of any agency, employer or job found directly or indirectly through this Site.
2.6 You acknowledge that the Internet or Our systems, services and equipment may from time to time be inoperative in full or in part as a consequence of but not limited to, mechanical breakdown, maintenance, hardware or software upgrades, any communication connectivity problems or other facts beyond the control of Us and You acknowledge that We will not be held liable for any failure or inability to provide continuous, error free, uninterrupted services under these or any other circumstances.
2.6 We may make changes in or withdraw any of the services described in this Site at any time without notice.
2.7 The services which We offer to candidates are entirely gratuitous and We shall not be obliged to maintain or continue any services offered to candidates on this Site. Without prejudice to the generality of the foregoing We reserve the right to suspend or cancel the provision of any service to any particular candidate for any reason whatsoever.
3 Registration
You must choose a password on completion of registration. You shall be responsible for all actions taken under that password and shall only access this Site using your own password. You should not disclose your password to any other person.
4 Information and E-mails You send or submit to Us
4.1 You should ensure that information You send to Us or any advertiser is accurate and you are prohibited from posting or transmitting to or from this Site any material that is libelous, obscene, indecent, seditious, pornographic, menacing, threatening, offensive, abusive, liable to incite racial hatred, discriminatory, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy, which may cause annoyance or inconvenience, fraudulent, which constitutes or encourages conduct that would be considered a criminal offence, gives rise to civil liability, or otherwise be contrary to the law of or infringes the rights of any third party, in the UK or any other country in the world; which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data) or for which You have not obtained all necessary licences and/or approvals.
4.2 You may not misuse this Site (including, without limitation) by hacking or committing fraud.
4.3 We will fully co-operate with any law enforcement authorities or court order requesting or directing Us to disclose the identity or locate anyone posting any material, misusing this Site or otherwise purporting to breach the law in contravention of Clauses 4.1 and 4.2 above.
4.4 If you breach any of the terms contained in Clauses 4.1 and 4.2 above, we will terminate the services provided by this Site.
4.5 We accept no responsibility or liability for the use by any agency, employer or other third party of any CV about you forwarded to any agency, employer (whether by Us or You) or to any third party which comes to Your attention directly or indirectly through Your use of this Site.
4.6 If You apply for any job or jobs using this Site You consent to Us monitoring and storing the information provided, together with the contents of any email.
5 Ownership of Intellectual Property Rights
Nothwithstanding any other rights granted to You, We retain all ownership, title and interest in the intellectual property rights contained in all material displayed in this Site, including (but not limited to) copyright, database rights, trade marks, patents, service marks, design rights (whether registerable or otherwise) know-how, trade or business names, domain names, goodwill associated with any of the foregoing and other similar rights or obligations whether registerable or not in any jurisdiction in the world.

Our use of CVs and other personal information supplied by users of this Site are governed by our Privacy Policy.
7 Links
7.1 We do not make any representation as to the security, quality or propriety of any Site which may be accessed through this Site. Linked websites accessed through this Site are independent websites over which We do not exercise any control, whether financial, editorial or any other kind and are not in any way endorsed by Us.
7.2 Accordingly We have no responsibility or liability to You in respect of any products or services purchased or obtained by You from any such linked website nor in respect of the use of any personally identifying information by any such linked website or its owner. If You decide to access any of the third party websites linked to this Site, you do so entirely at Your own risk.
7.3 If you have been granted permission to link to this Site, you may only do so on the basis that you link to, but do not replicate, the home page of this Site, and subject to the following conditions:
(a) You do not remove, distort or otherwise alter the size or appearance of Our logo;
(b) You do not create a frame or any other browser or border environment around this Site;

Bristol Job Market and Our logos on this site are trade names of Bristol Job Market Limited; You may not use these names or logos without Our consent.
11 Information : What We collect from you and what We do with it
The Internet is not a secure medium. However, We will use our reasonable endeavours to keep the personal information We receive about You confidential although nothing in these Terms shall restrict or prohibit Us disclosing personal information to recruitment agencies or employers in circumstances where You have expressly or by implication given Your consent to do so including for example where You have submitted Your CV containing such information. We use your information in accordance with our Privacy Policy from time to time and You consent to the use of Your information in such way.
12 Losses Resulting from Unauthorised Access to Your Data
You accept the risk that data transmitted electronically via this Site or otherwise may be intercepted before reaching its intended destination or accessed by unauthorised third parties and may be exploited unlawfully by such third parties. We do not assume responsibility for guarding against the acts of such third parties and shall not be liable for any direct, indirect, consequential, special or other damage resulting from third parties interception of or access to data of whatever nature.
13 Liability
13.1 We exclude all liability We may have to You to the fullest extent permitted by law (and whether such liability arises in contract, tort or otherwise) as a result of Your use of this Site or Your accepting of a job vacancy obtained directly or indirectly through this Site.
13.2 Nothing in these Terms shall exclude Our liability for death or personal injury due to Our negligence or for fraudulent misrepresentation.
13.3 If Your use of material on this Site results in the need for servicing, repair or correction of equipment, software or data You assume all costs thereof.
14 The Regulations
14.1 Work-seekers and recruiters need to be aware that this Site operates as a venue only and does not introduce or supply work-seekers to recruiters (or vice versa). This means that We do not:
(a) obtain sufficient information for potential recruiters to select a suitable work-seeker for the position which the recruiter seeks to fill;
(b) obtain confirmation of the identity of a work-seeker or that they have the experience, training, qualifications or authorisation to work in the position to be filled or that they wish to undertake the role to be filled;
(c) take any steps to ensure the work-seeker and recruiter are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the work-seeker to fulfil the position to be filled;
(d) take any steps to ensure that it would not be detrimental to the interests of the work-seeker or the recruiter for the work-seeker to fulfil the position to be fulfilled;
(e) give any indication to recruiters whether work-seekers are unsuitable (or suitable) for any position to be filled in any circumstances;
(f) propose work-seekers to recruiters or provide any information about them.
(g) take up any references in relation to a work-seeker; or
(h) make any arrangements for accommodation of work-seekers.
14.2 The Regulations seek to ensure that work-seekers are only proposed by agencies for roles for which they are properly qualified and that recruiters are only offered work-seekers who have the appropriate levels of experience, training, qualifications and authorisation for the position to be filled. Since we are only a venue and do not propose or introduce work-seekers to recruiters or vice versa, it is recommended that, if you are a work-seeker you undertake the steps set out in the Regulations to ensure your suitability for the role advertised or, if you are a recruiter, to ensure a work-seekers suitability for the role.
14.3 These could include:
(a) If you are a work-seeker; checking the identity of the recruiter and the nature of its business, the commencement date and duration of the position, the position to be filled including type of work, location, hours and risks to health and safety, experience, training, qualifications and authorisation which the recruiter considers necessary or are required by law or otherwise to undertake the position, whether any expenses are payable by you as a work-seeker or whether there are any requirements imposed by law or otherwise for you to satisfy before taking up a position.
(b) If you are a recruiter; checking the identity of the work-seeker and that the work-seeker has the experience, training, qualifications and authorisation required by law or otherwise for the position and whether there are any requirements imposed by law or otherwise for you, as the recruiter, to meet to enable a work-seeker to take up a position.
14.4 In addition, where professional qualifications are required or where work-seekers are to work with vulnerable persons or children, you should obtain copies of the relevant qualifications or authorisation, obtain at least two references from people who are not relatives of the work-seeker and undertake a criminal records bureau check of the work-seeker.
14.5 Any searching or screening tools provided by Us for use in Your assessment of the suitability or otherwise of any particular candidate or advertised vacancy are to assist You in taking these steps, but are not intended as a substitute.
15 Disclaimer
15.1 Whilst We endeavour to ensure that the information on this Site is correct, We do not warrant the accuracy and completeness of the material on this Site. We may make changes to the material on this Site at any time without notice. The material on this Site may be out of date, and we make no commitment to update such material. Please note that You will be required to use caution, common sense and good awareness as there are also risks of dealing with persons or people acting under false pretences. By using this Site You agree to all risks and agree that We are not responsible for the acts or omissions of others.
15.2 The material at this Website is provided “as is” without any conditions, warranties or other terms of any kind. Any legal notices shall be sent to Our address above or in Your case, the address provided to Us during Your registration or other address set out in any other written agreement between us. Notices may be delivered by hand or first class letter post and shall be deemed to be delivered, if by hand, at the time when delivered (provided such delivery is during normal working hours, if not then 10.00 a.m. on the next working day) and if by first class letter post then two working days thereafter.
18 Governing Law
Even if not actually the case, these Terms shall be deemed to have been made in England and the construction, validity and performance of these Terms shall be governed in all respects by the laws of England and Wales and any dispute connected with this Site is subject to the exclusive jurisdiction of the Courts of England.
